    This paper reviews sections 8 and 9 of the Federal Child Support Guidelines and the emerging case law under each. The discussion begins with split custody under s.8,both because it is the simpler provision and because the basic concept underlying the assessment of child support in split custody cses is often (rightly or wrongly) relied upon in shared custody cases under s.9. At the end of the paper, there are two appendices which list the cases dealing with each of these provisions

    Family law should be a leader in recognizing gay and lesbian relationships because we will never achieve equality unless we break down exclusionary notions of family. This paper attempts to provide exclusionary notions of family. This paper attempts to provide assistance to the practitioner whose gay and lesbian clients are seeking equal access to the rights and remedies of family law. We discuss the formation of same sex relationships, including marriage and building a family, and separation issues like support, property, and custody and access. We also offer some general suggestions for drafting cohabitation agreements. The paper includes references to the international treatment of gay and lesbian relationships, and to sociological and psychological research which may be useful in confronting homophobic stereotypes before the courts.
